1) The certificate of competence to process draft cataloguing data on the product is issued by the Authority based on the request of the future agency. The following shall be attached to the application:
- Certified extract from the Commercial Register or certified copy of Trade Certificate.
- Design methodology for processing cataloguing data on the product for its identification.
- Document proving access to application software for processing cataloguing data on the product for its identification.
- Draft cataloguing data on the product, processed according to test documents.
2) The Authority shall initiate administrative proceedings pursuant to Act No. 500/2004 Coll., Administrative Code, as amended, and shall notify the potential agency in writing that it has done so.
3) The Authority will assess the documents provided by the potential agency when applying for a certificate within the statutory period and decide on the application.

§ 11
(1) The Agency shall attach the following documents to the application for a certificate of competence to process draft cataloguing data on the product:
- a certified extract from the commercial register or a certified copy of the trade certificate with a defined subject of business in the field of processing draft cataloguing data,
- methodology for processing draft cataloguing data about the product for its identification,
- document proving access to application software for processing draft cataloguing data about the product,
- draft cataloguing data on the product, prepared according to the Authority’s test documents.
(2) The Authority
- issues a certificate of competence to the agency to process draft cataloguing data on the product, if the documents referred to in paragraph 1 letter b) to d) is processed in accordance with the cataloguing system, or
- decides to suspend proceedings on the agency's ability to process draft cataloguing data on the product, if the agency does not submit any of the documents listed in paragraph 1 or if the documents listed in paragraph 1 letter b) and d) processed in accordance with the cataloguing system.
(3) If the Authority discovers that the draft cataloguing data on the product processed by the agency, which was issued a certificate of competence, is not in accordance with the cataloguing system, it shall suspend the effectiveness of the certificate of competence or withdraw the certificate of competence. This decision cannot be appealed.
§ 15
Rights and obligations of the agency
(1) Based on the certificate of competence issued by the Authority, the agency is authorized to process draft cataloging data on the product for the benefit of the user.
(2) Once a year, but no later than January 31 of the following year, the agency is obliged to submit to the Authority an overview of the processed drafts of cataloging data on products with an indication of users.
